California’s Largest Law Enforcement Union Joins Eight Others in Opposing Newsom

Zero Law Enforcement Groups Support Newsom

SACRAMENTO, CA (May 10, 2016) – The California Correctional Peace Officers Association (CCPOA), the state’s largest law enforcement union, announced its opposition to Gavin Newsom’s ammunition proposal. In an open letter to the citizens of California, CCPOA President Chuck Alexander says that the organization “vehemently opposes” Newsom’s proposal, which “lessens our ability to protect ourselves and the public.”

The first public hearing on Newsom’s proposal was held in Sacramento this week, with representatives from several law enforcement organizations on hand to voice their opposition. Newsom chose not to attend and has not won the support of any law enforcement organizations.

The CCPOA is the latest law enforcement organization to stand against Newsom’s proposal. The nine organizations represent thousands of officers, prosecutors, sheriffs and other officials on the frontline of public safety. Groups opposing Newsom’s proposal so far include:

  • Association of Deputy District Attorneys of Los Angeles
  • California Correctional Peace Officers Association
  • California Fish and Game Wardens’ Association
  • California Reserve Peace Officers Association
  • California State Sheriffs’ Association
  • Law Enforcement Action Network

“It’s telling that California’s law enforcement experts are overwhelmingly critical of Newsom’s proposal,” said Chuck Michel, a co-chair of the Coalition for Civil Liberties, a diverse group of Californians opposed to Newsom’s ballot initiative. “They’re the ones risking their lives every day and have a unique vantage point on what it takes to keep our streets safe. We should be listening to them, not politicians out to promote their own personal interest.”

The Assembly and Senate Public Safety Committee is scheduled to hold an informational hearing tomorrow, Tuesday May 3, at 9:30am in hearing room 4203, on Lt. Governor Gavin Newsom’s gun control initiative, “The Safety for All Act of 2016.”  A vote will not be taken at this hearing however members are encourage to contact members of the committee with their opposition to the initiative and similar legislation that is currently moving through the Legislature.  Assembly Public Safety Committee contact information can be found hereand the Senate Public Safety Committee contact information can be found here or you can click the take action button below.

The NRA is joined by a growing number of diverse organizations that have publicly come out in opposition to Newsom’s gun control imitative. These groups include: the California State Sheriffs’ Association, the Association of Deputy District Attorneys, Congress of Racial Equality, Women Against Gun Control, and the San Francisco Veteran Police Officers Association, just to name a few.  These are all reputable organizations opposing this misguided initiative that recognize “The Safety for All Act of 2016” will do nothing to criminals, nothing to stop gun crimes and will only harm the law-abiding citizens of California.

According to the official language submitted to the Attorney General, Newsom’s intiative includes a laundry list of proposals that restrict, complicate and increase the cost of exercising your Second Amendment rights. Notable provisions include:

House-to-House Confiscation of Private Property – Millions of legal magazines will need to be sold out-of-state, taken out-of-state, or seized by law enforcement.  Many legal firearms are designed around magazines that can hold more than 10 rounds, making them effectively useless for self-defense, competitive shooting, and hunting.  This backdoor gun ban is not just on future sales, but forces you to surrender your existing private property to law enforcement.

Restricting Legal Ammunition Vendors – Thousands of ammunition retailers will be prohibited from selling ammunition in California.  Vendors will be required to pay additional fees to have their employees authorized as a seller of ammunition.  Out-of-state ammunition vendors will be prohibited from directly selling ammunition into California.  Because of its ineffectiveness, in 1986, the director of the Bureau of Alcohol, Tobacco and Firearms supported repeal of a similar federal ammunition record-keeping requirement: “The Bureau and the [Treasury] Department have recognized that current recordkeeping requirements for ammunition have no substantial law enforcement value.”  These ammunition restrictions will severely curtail the exercise of constitutionally protected conduct while providing no law enforcement value.

Leaving the Range With Ammunition – By criminalizing the private sale or transfer of ammunition, it will be a crime to share ammunition with a friend or family member to finish up a hunting trip or day at the range. The initiative would even prohibit leaving the range with any unused ammunition purchased at the range.

Costly Fees & Long Waits Just to Acquire Lawful Ammunition – This latest attempt to reduce the exercise of Second Amendment rights includes yet another excessive fee under the guise of more background checks.  Newsom wants you to pay another $50 fee and wait 30 days for authorization to purchase ammunition.  Law-abiding gun owners who have already gone through the burdensome firearm safety certificate procedures would not be exempt from the new ammunition authorization requirement.  The authorization would be added on top of California’s already complicated regime of firearm and ammunition regulations.

Lost and Stolen Reporting – This requirement would turn law-abiding citizens into criminals should they fail to report lost or stolen firearms to police within a limited amount of time after they “should have known” the firearm was missing.  Governor Brown has already vetoed similar legislation twice because it would do nothing to improve public safety in California.

Defeating Newsom’s gun control initiative will be a fight through November and it’s imperative that you help educate your family, friends and other Californians. Newsom is operating under the guise of “safety” to mislead citizens into somehow thinking restricting and creating new crimes against law-abiding citizens will curb criminal activity. The truth is, this initiative creates new crimes for the law-abiding while ignoring the acts of criminals.  Don’t let Newsom’s propaganda fool you because he has never met a gun control measure he doesn’t like including pushing for a complete handgun ban while serving as the Mayor of San Francisco.

In his L.A. Times OP-ED piece opposing Gavin Newsom’s “Safety for All” initiative, UCLA Professor Adam Winkler starts his analysis by looking at the desirability of the measure’s actions. His thoughts on background checks for ammo buyers and magazine restrictions deserve their own post, so I’ll get to those later. Prof. Winkler specifically addresses the initiative’s “large capacity” magazine ban and its potential ill effect upon the rule of law; however, these concerns apply to all gun control laws…

What if we passed a law knowing that even usually law-abiding people wouldn’t comply with it? This fall, California voters may do just that if they approve Lt. Gov. Gavin Newsom’s Safety for All gun reform initiative. The result could be a small enhancement in public safety, and a potentially significant increase in disrespect for the law.

Some people have an ideological opposition to any gun control law. Yet when 95% of gun owners don’t comply with a law, it’s not just the die-hards objecting. Legal theorists argue that people are more likely to comply with laws they view as morally or socially just. To a person whose gun came standard with one of these magazines and who has owned it for years without incident, the idea that these devices are inherently dangerous does not resonate.

In the absence of cooperation from gun owners, the large-magazine ban is unenforceable. It would be practically and politically impossible for the government to go door to door to find and collect the magazines. The ban will be enforced only when someone gets caught with one, say in a search related to an arrest.

Americans have tried over and over to outlaw things that some insist are objectionable and others enjoy. Prohibition was repealed when its supporters realized that the disobeyed laws against alcohol brought the whole legal system into disrepute.

We have addressed these concerns beforeEven if we accept the premise of a particular gun law, its actual benefit to society must also take into account its effect on the rule of law. Take, for example, as Prof. Winkler did, California’s 1990 “assault weapon” ban. The State estimated that there were 300,000 qualifying firearms in California at the time that should have been registered as “assault weapons”. Only 7,000 were actually registered. That’s a compliance rate of 2.3%.

So what happened to the other 293,000 naughty, naughty guns? Nothing. Has anything bad happened? No, not if we only look in terms of crimes committed. Those guns were (and probably still are) in the hands of otherwise law abiding citizens. These aren’t people inclined to commit violent crimes. However, they’re still criminals under the law. It is more accurate, though, to think of them as manufactured criminals. They weren’t doing anything wrong. They State just decided to declare them to be criminals.

But this is where we see the true harm that was done by that law. The State issued multiple threats to those noncompliant gun owners to get them to obey the new law. They were threatened repeatedly with arrest. Next, the State extended the registration deadline trying a softer touch. Neither approach worked. Those guns are still unregistered.

So a law was passed and promptly ignored by tens of thousands of our citizens. While there weren’t physical injuries that resulted from this, there was tremendous violence done to the rule of law. We are, allegedly, a nation of laws, not of men. When government inspires the People themselves to ignore the law, we stop being such a nation.

There have been reports of misconduct by paid signature gatherers circulating petitions to put Gavin Newsom’s “Safety For All” initiative on the ballot. While it’s perhaps perfectly acceptable for a ballot measure to have a dodgy, misleading name, it’s not permissible for signature gatherers to mislead the public as to what that measure does. The “Safety For All” initiative, as per the Lt. Governor’s website, does the following…

  1. Prohibits Possession of Large-Capacity Military-Style Magazines: The Safety for All initiative outlaws possession of large-capacity magazines of 11 rounds or more and provides for their legal disposal. If passed, California would join New York, New Jersey, Hawaii and The District of Columbia in banning possession of these military-style clips.
  2. Treats Ammunition Sales Like Gun Sales: The initiative requires licensing of ammunition vendors and point-of-sale background checks for ammunition purchases. Under the initiative, if a person is convicted of a felony, a violent misdemeanor, has a restraining order or has been declared dangerously mentally ill, they will no longer be able to buy ammunition in California. California would be the first state to require background checks at point of sale.
  3. Ensures People Prohibited from Owning Guns Do Not Possess Them: The initiative defines a clear firearms relinquishment process for those convicted of a felony or a violent misdemeanor.
  4. Requires Reporting Lost or Stolen Guns: The initiative requires firearm owners to notify law enforcement if their firearm has been lost or stolen. With the Safety for All initiative, California would join 11 other states and the City of Sacramento requiring lost and/or stolen firearm reporting.
  5. Shares Data with Federal System on Prohibited People: The initiative mandates that California share data with the FBI/NICS (National Instant Criminal Background Check System).

It does not ban “assault weapons”. Nor does it require background checks for all gun sales. Nor does it “ban machine guns” or do anything else that might sound more sellable to gun muggle leaving Wal-Mart. It only does the five things listed above; no more, no less.

If you witness a signature gatherer making false claims about what the initiative does, you are urged to report their misconduct to Michel and Associates. To that end, this package has been prepared for witnesses to report misconduct. The package include instructions on how to best document what you saw, a form for reporting the violations, and a letter from Michel and Associates that can (optionally) be given to the signature gatherer. Yesterday, Wednesday, March 30, 2016, the Coalition for Civil Liberties announced that The Western State Sheriffs’ Association and the Law Enforcement Action Network (LEAN) have officially opposed Lieutenant Governor Gavin Newsom’s gun control ballot initiative misnamed the “Safety for All Act of 2016.”  The Coalition for Civil Liberties Official announcement is below.  The two organizations should be commended for taking this position.

Gavin Newsom is looking to give criminals a break and people are taking notice.  Last week, the editorial board of the Orange County Register wrote about his “fancifully titled” proposition, and the next day, the newspaper published an opinion piece by Los Angeles Deputy District Attorney Michele Hanisee (a co-chair for the Coalition for Civil Liberties).

Today, two more important organizations voiced their opposition to Newsom’s ballot initiative.  The Western State Sheriffs’ Association represents Sheriffs and their command staff across 15 states.  It’s a big deal to see an organization with such a huge constituency paying close attention to what happens in one state, and it says a lot about the danger our law enforcement officials see in Newsom’s plan.

Also critical of Newsom’s initiative is the Law Enforcement Action Network (LEAN), a national non-profit organization that fights against policies that favor criminals at the expense of the police and the public.  LEAN’s advocacy on behalf of our police officers ensures critical decisions affecting our safety are made by frontline officers and prosecutors – not self-serving politicians like Newsom.

Newsom’s campaign continues to use scare tactics to confuse well-intentioned Californians into gun control measures that don’t do anything to stop crime or terrorism.  We need your help to set the record straight.  Please join us by:

As you heard in the interview, paid signature gatherers are reportedly “misstating” the effects of the Newsom initiative. This initiative will ban possession of all magazines capable of accepting more than 10 rounds, regardless of when said magazines were purchased. It also requires background checks for all ammunition purchases. Signature gatherers have allegedly been telling the gun muggles in front of Wal-Mart or Target that the initiative will “ban assault weapons” or “require background checks on all gun purchases”. It does neither. If you witness a signature gatherer saying these things, make a video of what you saw and report it to Michel and Associates or to the CRPA. See somethin’, say somethin’!

A dozen gun rights and law enforcement organizations in the state have banded together to form the Coalition for Civil Liberties and set up a dedicated website,stoptheammograb.com, in an effort to get the word out against the [California Safety for All Act].

Member groups include the California Rifle & Pistol Association, FFLGuard, Jews Can Shoot, the CalGuns Shooting Sports Association and the California Reserve Peace Officers Association.

Besides the Coalition for Civil Liberties group, others have come out swinging against the Newsom plan.

The 1,000-member strong Association of Deputy District Attorneys for Los Angeles County went on file against the proposal on March 16.

The DA group joined the “thin green line” of the California Fish and Game Wardens’ Association and California State Sheriffs’ Association, both of which announced their opposition earlier this month.

“Effectively, this measure will create a new class of criminals out of those that already comply with common sense practices that now exist,” wrote Amador County Sheriff Martin Ryan, president of the CSSA. “The focus of efforts to reduce gun violence in this state should be on those responsible for that violence, not those that have no intent to do harm.”

The National Rifle Association and Firearms Policy Coalition have also slammed the Safety for All Act.

California: Coalition for Civil Liberties Announces Los Angeles Association of Deputy District Attorneys Opposition to Newsom Ballot Initiative

Today, March 17, 2016, the Coalition for Civil Liberties announced that the Los Angeles Association of Deputy District Attorneys (ADAA) officially delivered a letter to Lieutenant Governor Gavin Newsom OPPOSING his gun control ballot initiative misnamed the “Safety for All Act of 2016.”  The Coalition for Civil Liberties Official announcement is below.  We commend the ADAA for taking this position.

Today, the Los Angeles Association of Deputy District Attorneys (ADAA) delivered a letter to Newsom’s campaign office announcing its opposition to Gavin Newsom’s ill-conceived ballot initiative.

ADAA President Michele Hanisee writes:  “[Newsom’s initiative] would do nothing to stop criminals from getting ammunition or larger-capacity magazines.  The actual result is that it further incentivizes the criminals to commit residential burglaries and armed robberies of gun stores.”  You can read the full letter on our website and read the story in the Los Angeles Times.

Earlier this week, the California State Sheriffs’ Association sent Newsom a similar message, which was reported by The Sacramento Bee.  The Sheriffs and Prosecutors working to keep criminals off California’s streets are in agreement:  Gavin Newsom’s self-serving ballot initiative must be stopped.

The scope of the opposition to Newsom’s initiative is growing, but he’s already raised more than $1 million and has a significant advantage with an office in the Sacramento Capitol building.  We need to tell Newsom that he cannot use ISIS-inspired attacks to deceive Californians into giving up our civil liberties.  We need to preserve our right to protect our families and ourselves as we choose.  You can help by:
